Terms and conditions

AI Overview is a service of Camino Agency, with its registered office at Kokkenhoflaan 8 BSA, 3513 GN Utrecht, the Netherlands, registered with the Dutch Chamber of Commerce under number 71100148. You can reach us at contact@caminoagency.com.

Please read these terms before you take out a subscription: they set out what we do and do not promise. The short version: we make every effort to get AI engines to name your business, but we cannot guarantee any result, and the risk of using the service is yours.

The service is intended for business use. We do not contract with consumers.

Article 1 — Definitions

  1. 1.1

    AI Overview, we, us, our: Camino Agency, with its registered office at Kokkenhoflaan 8 BSA, 3513 GN Utrecht, the Netherlands, registered with the Dutch Chamber of Commerce under number 71100148.

  2. 1.2

    Customer, you, your: the natural person or legal entity acting in the course of a profession or business who enters into an agreement with us.

  3. 1.3

    Service: the subscription to AI Overview. This covers the autonomous agent that researches topics, writes articles and publishes them on the (sub)domain designated by the customer, and the dashboard that reports on it.

  4. 1.4

    AI engines: third-party generative search and answer systems, such as Google (AI Overview and Gemini), OpenAI's ChatGPT, Anthropic's Claude and Perplexity, including the crawlers they use.

  5. 1.5

    Content: all articles, texts, images and other materials the agent generates or publishes on the customer's instructions.

  6. 1.6

    Agreement: the arrangement between us and the customer for the delivery of the service, including these terms.

  7. 1.7

    In writing: on paper, by email or through the dashboard.

Article 2 — Applicability

  1. 2.1

    These terms apply to every offer, every sign-up and every agreement between us and the customer, and to everything arising from them.

  2. 2.2

    The service is offered to businesses only. By creating an account, the customer confirms that it is acting in the course of a profession or business.

  3. 2.3

    We expressly reject any purchasing terms or other terms of the customer.

  4. 2.4

    Departures from these terms apply only if we have confirmed them in writing, and only for the agreement they were agreed for.

  5. 2.5

    If a provision is void or is annulled, the remaining provisions continue to apply. The provision concerned is replaced by a valid provision that stays as close as possible to its intent.

  6. 2.6

    Where these terms conflict with a separate written arrangement, the written arrangement prevails.

Article 3 — Agreement, term and cancellation

  1. 3.1

    The agreement is concluded as soon as the customer creates an account and confirms a subscription.

  2. 3.2

    The subscription runs for one month and is then tacitly renewed for one month at a time, until the customer or we cancel.

  3. 3.3

    The customer may cancel at any time through the dashboard or by email. Cancellation takes effect at the end of the current billing period. Subscription fees already paid are not refunded.

  4. 3.4

    We may cancel the agreement subject to one month's notice.

  5. 3.5

    At the end of the agreement the agent stops publishing and access to the dashboard ends. Content already on the customer's domain remains the customer's. We may delete dashboard data thirty days after the end of the agreement.

Article 4 — Performance of the service

  1. 4.1

    We perform the agreement to the best of our insight and ability, with the care that may be expected of a reasonably competent service provider.

  2. 4.2

    Everything we do under the agreement is a best-efforts obligation and expressly not an obligation to achieve a result. We commit to performing well, not to reaching a particular outcome.

  3. 4.3

    We decide how we perform the service. This includes the choice of topics and search queries, the structure and tone of the content, the timing of publication, and the AI models, suppliers and techniques we use.

  4. 4.4

    We may further develop and adjust the service and replace parts of it. If we materially reduce functionality, we will say so in advance and the customer may cancel as of the date that change takes effect.

  5. 4.5

    We make every effort to keep the service available, but we do not guarantee uninterrupted availability. Maintenance, faults, and outages or restrictions at hosting providers, model suppliers or third-party APIs may interrupt or delay the service.

  6. 4.6

    We may engage third parties in performing the agreement.

Article 5 — No guarantee of results

  1. 5.1

    The service is designed to increase the chance that AI engines name the customer's business. That is a chance, not a promise.

  2. 5.2

    We expressly do not guarantee that:

    1. the customer will be named, cited or linked in an AI Overview, in ChatGPT, Gemini, Claude, Perplexity or any other AI engine;
    2. published content will be crawled, indexed, retained or used by search engines or AI engines;
    3. the customer will reach or keep a particular position, visibility or frequency of mention;
    4. visibility will lead to visitors, enquiries, customers, revenue or profit;
    5. results achieved will persist;
    6. results will occur within any particular period.
  3. 5.3

    AI engines and search engines are third-party services over which we have no influence. They set their own algorithms, sources, presentation and terms, and may change, restrict or discontinue them at any time, without notice. They may exclude or downgrade content, domains or entire categories.

  4. 5.4

    Timeframes, examples, figures, charts, sample dashboards and expectations on our website, in presentations or in conversation — such as “expected results in about six weeks” — are indicative and meant as illustration. They are not promises, guarantees or forecasts, and the customer can derive no rights from them.

  5. 5.5

    Results we have achieved earlier or for other customers say nothing about the results this customer will achieve.

  6. 5.6

    The measurements in the dashboard are samples of AI engine answers at a given moment. AI engines give different answers to the same question for different users and at different times. The figures are therefore an indication, not a complete or exact representation.

  7. 5.7

    A lack of results, of whatever kind, is not a failure on our part. It gives the customer no right to rescission, suspension of payment, a discount, a refund or damages. The customer remains liable for the agreed price for as long as the agreement runs.

Article 6 — The customer's risk and responsibility

  1. 6.1

    The customer uses the service at its own expense and risk. The commercial risk of that choice — including the risk that the time spent and the subscription fees paid yield nothing — lies entirely with the customer.

  2. 6.2

    The customer decides whether the service suits its business, market and goals. We give no legal, tax, medical, financial or other professional advice, and the content is not such advice either.

  3. 6.3

    The content appears on a domain of the customer and under the customer's name. Towards third parties the customer is the publisher of that content and is responsible and liable for it.

  4. 6.4

    The content is generated automatically with AI. It may contain inaccuracies, outdated or incomplete information, invented details or unfortunate wording. The customer is aware of this risk and accepts it.

  5. 6.5

    The customer is responsible for checking published content, in particular for factual accuracy, for statements about prices, products and results, and against the rules that apply to its profession or sector. The customer may ask us at any time to amend or remove content; we carry out such a request as soon as possible.

  6. 6.6

    The customer is responsible for its domain name, DNS settings, hosting, the footer link and the technical state of its own website, and for the accuracy and completeness of the information it gives us. We may rely on that information.

  7. 6.7

    The customer warrants that it holds the rights to the material it supplies or has processed, and that using it does not infringe third-party rights.

  8. 6.8

    Publishing content may affect the findability, reputation or standing of the customer's domain — including adversely, for example through a search engine measure or manual action. That risk lies with the customer.

  9. 6.9

    The customer is responsible for keeping its login details confidential and for everything that happens through its account.

  10. 6.10

    The customer indemnifies us against third-party claims relating to the content, to the customer's use of the service or to a failure to comply with this article, and reimburses the costs we incur as a result, including reasonable legal fees.

Article 7 — Prices and payment

  1. 7.1

    Prices are stated on our website, are in euros and are exclusive of VAT, unless expressly stated otherwise.

  2. 7.2

    Subscription fees are invoiced monthly in advance and collected automatically through the payment method the customer has provided.

  3. 7.3

    We may adjust our prices. We announce a price increase at least thirty days in advance. If the customer does not agree, it may cancel as of the date the new price takes effect.

  4. 7.4

    If a payment fails, we may suspend the service until payment is made. The customer is then in default without notice of default, and we may charge statutory commercial interest and extrajudicial collection costs.

  5. 7.5

    The customer may not suspend payment and may not set off.

Article 8 — Intellectual property

  1. 8.1

    All rights to the service, the platform, the agent, the models, the prompts, the dashboard, the documentation and the brand identity rest with us or with our licensors. The customer receives a non-exclusive, non-transferable right of use for the term of the agreement.

  2. 8.2

    The customer may use, adapt and keep publishing the content the agent publishes for it without restriction, including after the agreement ends. Insofar as rights in it rest with us, we grant the customer a perpetual, worldwide, royalty-free right of use for that purpose, provided the customer has met its payment obligations.

  3. 8.3

    AI-generated content is not always protected by copyright, and similar content may also be delivered to others. We guarantee neither exclusivity nor copyright protection of the content.

  4. 8.4

    We may use anonymised and aggregated data about use of the service to improve the service.

  5. 8.5

    We may use the customer's name and logo as a reference, unless the customer objects in writing.

Article 9 — Personal data

  1. 9.1

    We process personal data in accordance with the General Data Protection Regulation and our privacy statement.

  2. 9.2

    Insofar as we process personal data on the customer's instructions, we are the processor and the customer is the controller. Our data processing agreement applies to that processing.

  3. 9.3

    We engage other processors for the service, including providers of AI models, hosting and analytics. The customer consents to this. We provide a current list on request.

Article 10 — Liability

  1. 10.1

    Our liability is limited to compensation for direct loss, up to the amount the customer paid us in the three months preceding the event causing the loss, with a maximum of € 2.500 per event and per contract year. A series of related events counts as one event.

  2. 10.2

    We are not liable for indirect loss. This includes in any event lost revenue and profit, lost savings, missed opportunities, loss of visibility, positions or traffic, reputational harm, loss or corruption of data, and loss caused by business interruption.

  3. 10.3

    In particular, we are not liable for loss resulting from:

    1. the absence of mentions, visitors, enquiries or revenue;
    2. changes at, or measures taken by, search engines and AI engines, including the exclusion or downgrading of a domain;
    3. inaccuracies in AI-generated content that the customer published or left published;
    4. faults, restrictions or discontinuation of third-party services;
    5. incorrect or incomplete information from the customer, or the customer's own acts or omissions.
  4. 10.4

    We are liable only after the customer has given us written notice of default and a reasonable period to perform, and we still fall short after that.

  5. 10.5

    A claim lapses if the customer does not notify us of it in writing within twelve months of discovering the loss or of the moment it could have discovered it.

  6. 10.6

    The limitations in this article do not apply in the event of intent or deliberate recklessness on the part of us or our management.

  7. 10.7

    These terms are also stipulated for the benefit of our employees and the third parties we engage.

Article 11 — Force majeure

  1. 11.1

    We do not have to perform if we are prevented from doing so by force majeure. In that case we owe no damages.

  2. 11.2

    Force majeure includes in any event: outage, failure, restriction or discontinuation of third-party services the service depends on, including AI models and their APIs, search engines, hosting, DNS and payment services; changes to those third parties' terms or policies; cyberattacks; power and internet failures; government measures; and war, pandemic or natural disaster.

  3. 11.3

    If force majeure lasts longer than sixty days, either party may cancel the agreement for the part not yet performed.

Article 12 — Suspension and termination

  1. 12.1

    We may suspend the service or terminate the agreement with immediate effect if the customer fails to meet its obligations, if the customer is declared bankrupt or applies for suspension of payments, or if we may reasonably assume the service is being used for misleading, unlawful or criminal purposes.

  2. 12.2

    We may refuse to publish content or remove published content if, in our judgement, it conflicts with the law, with the terms of a third party involved or with these terms, or if it may harm us or our service.

  3. 12.3

    Suspension or termination under this article gives the customer no right to a refund or to damages.

Article 13 — Confidentiality

  1. 13.1

    Each party keeps the other's confidential information secret and uses it only to perform the agreement. This obligation survives the end of the agreement.

Article 14 — Changes to these terms

  1. 14.1

    We may change these terms. We announce a change at least thirty days before it takes effect, by email or through the dashboard.

  2. 14.2

    If a change materially puts the customer in a worse position, the customer may cancel the agreement as of the date the change takes effect. If the customer does not cancel, the new terms apply.

  3. 14.3

    The current version is always available at getaioverview.com/terms.

Article 15 — Governing law and disputes

  1. 15.1

    Dutch law applies to the agreement and to these terms. The Vienna Sales Convention is excluded.

  2. 15.2

    Disputes are submitted to the competent court of the District Court of Midden-Nederland, location Utrecht, unless mandatory law prescribes otherwise.

  3. 15.3

    These terms were drawn up in Dutch. In the event of a difference between the Dutch text and a translation, the Dutch text prevails.
